DMCA Policy

Reporting Copyright Infringement

Whimsy Travel ("Company") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond expeditiously to valid notices of alleged copyright infringement relating to content posted on or through the Service.

The Service allows users to upload content, including photos and trip information. If you believe that content on the Service infringes your copyright, you may submit a written notification to our designated agent:

Your notification must be a written communication and must include substantially the following (per 17 U.S.C. § 512(c)(3)):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to be infringed, or a representative list of works
  • Identification of the infringing material and information reasonably sufficient to locate it (such as the trip name or URL)
  • Your contact information (address, telephone number, and email address)
  • A statement that you have a good-faith belief the use is not authorized by the owner, their agent, or the law
  • A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the owner or authorized to act on the owner's behalf

Under the DMCA, knowingly misrepresenting that material is infringing may subject you to liability. Please consider whether your claim is valid before submitting a notice.

How We Respond

Upon receiving a valid notice, we will remove or disable access to the allegedly infringing material expeditiously. We will make a reasonable effort to notify the user who posted the material that it has been removed.

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our designated agent including:

  • Your physical or electronic signature
  • Identification of the material removed and its prior location
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification
  • Your name, address, telephone number, and consent to the jurisdiction of the federal court in your district (or, if outside the US, any judicial district in which we may be found), and an agreement to accept service of process from the party who filed the original notice

Upon receiving a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

Repeat Infringers

It is our policy, in appropriate circumstances, to terminate the accounts of users who are determined to be repeat infringers of copyright or other intellectual property rights.
